ANIMA – CECODEV

The present Internal Regulations are updated in accordance with the evolution of legislation, notably the provisions of Decree 2019-1143 of November 7, 2019 (Article 4). They comply with Articles L.6352-3 and 5 and R.6352-1 to 15 of the French Labor Code. Criminal sanctions are outlined in Articles L.6355-8 and 9 of the Labor Code.

This document is available and accessible to all trainees before they begin their training.

A copy of these regulations is permanently displayed in each training room and on the Cecodev website.

Preamble

Purpose and Scope of the Regulations

These Regulations apply to all trainees enrolled in a session provided by ANIMA CECODEV for the entire duration of their training. Each trainee is deemed to have accepted the terms of these regulations when attending training delivered by ANIMA CECODEV and agrees to comply with the measures that may be taken in case of non-compliance.

Training Location

The training takes place either on ANIMA CECODEV premises, in external venues, or remotely. The provisions of these Regulations apply within ANIMA CECODEV premises and any ancillary spaces (classrooms, visited sites, etc.) for the entire duration of the training.

However, in accordance with Article R 6352-1 of the French Labor Code, when training takes place within a company or establishment that already has internal regulations, the hygiene and safety measures applicable to trainees are those of the latter regulations.

When training is delivered remotely, these regulations apply except for Articles 8, 9, 11, and 20.

Information Provided to the Trainee Before Final Enrollment

(According to the provisions of Article L6353.8 of the French Labor Code, amended by Law 2018-771 of September 5, 2018)

  • Professional objectives and skills development objectives, as well as the training content.
  • Training schedule.
  • Training assessment methods.
  • Contact details of the educational advisor.
  • Internal regulations applicable to the training.
  • Fees.
  • Payment terms and financial conditions in case of early termination or withdrawal during the training.

Information Requested from the Trainee

(According to the provisions of Article L6353.9 of the French Labor Code, amended by Law 2018-771 of September 5, 2018)

Information requested by the training organization from a trainee, regardless of its form, may only be intended to assess the trainee’s ability to follow the training, whether requested, offered, or continued. This information must be directly and necessarily related to the training and must be provided in good faith.

Publication

These regulations come into effect upon publication on the ANIMA CECODEV website. They are accessible and must be consulted and accepted by the trainee before any final enrollment.


SECTION 1: HYGIENE AND SAFETY RULES

General Principles

The prevention of accidents and illnesses is imperative and requires everyone to comply with:

  • Applicable hygiene and safety regulations on training premises.
  • Any instructions imposed by the training organization’s management, the manufacturer, or the trainer, particularly regarding the use of equipment provided.

Each trainee must ensure their personal safety and that of others by adhering to general and specific hygiene and safety instructions related to their training.

If a trainee detects a malfunction in the safety system, they must immediately notify the training organization’s management.

Failure to comply with these instructions may result in disciplinary sanctions.

Fire Safety Instructions

In accordance with Articles R. 232-12-17 and following of the French Labor Code, fire safety instructions, including the location of fire extinguishers and emergency exits, are displayed in training facilities to be known and followed by all trainees.

Alcoholic Beverages

Trainees are prohibited from entering or remaining on the premises while intoxicated, as well as bringing alcoholic beverages onto the premises.

Smoking Prohibition

In accordance with Decree No. 92-478 of May 29, 1992, which establishes the conditions for banning smoking in shared-use spaces, smoking and vaping are prohibited in training facilities.

Accidents

Any accident or incident occurring during or in connection with the training must be immediately reported by the injured trainee or witnesses to the training organization’s manager.

In accordance with Article R. 962-1 of the French Labor Code, an accident occurring to a trainee while on training premises or while commuting to or from the training site must be reported by the training organization’s manager to the competent social security office.


SECTION 2: GENERAL DISCIPLINE

Attendance, Punctuality, and Absences

Trainees are required to attend all sessions scheduled by the training provider, with regular attendance and punctuality, without interruption. For in-person training, attendance sheets are signed by trainees twice a day and countersigned by the instructor.

For remote training, digital attendance sheets or screen captures for each day and a final certificate signed by the participant serve as proof of attendance.

Notifications:

  • Any foreseeable absence must be reported by email, regardless of the reason.
  • In case of illness, the trainee must inform ANIMA CECODEV as soon as possible on the first half-day of absence.
  • In the event of a work-related or commuting accident, the circumstances must be communicated within 48 hours.

Training Schedule

The training schedule is set by the organization and communicated to trainees either via electronic invitation or by providing the training program. Trainees must adhere to the schedule.

The training provider reserves the right to modify the schedule as necessary within the limits imposed by applicable regulations. Trainees must comply with any schedule changes.

In case of absence or delay, trainees must notify the training manager.

Access to Training Premises

Unless expressly authorized, trainees who have access to the training premises may not:

  • Enter or remain on the premises for purposes other than training.
  • Facilitate the entry of unauthorized third parties.

Dress Code and Behavior

Trainees are expected to present themselves in appropriate attire and behave respectfully toward all individuals present within the organization.

Participation

Each trainee is expected to participate actively:

  • Attend to learn, including from one another.
  • Understand that coaching training or other methods are neither a necessity nor an advantage in co-development facilitation.
  • Accept feedback.
  • Maintain simplicity in posture and language.
  • Commit to kindness and respect toward everyone.

Confidentiality and Recordings

Participants must respect the confidentiality of individuals and situations discussed during co-development sessions.

  • In-Person Training:
    • Recording or filming training sessions is strictly prohibited unless expressly authorized.
    • Participants are requested not to use laptops, tablets, or smartphones during practice sessions, as their presence may create discomfort or imply recording.
    • Participants who are unaccustomed to handwriting are asked to make an effort to respect this rule, as it helps create a conducive environment for the sessions.
  • Remote Training via Internet Platform:
    • Recording the training is prohibited.
    • Allowing unauthorized individuals to observe or listen to the training is forbidden.

Documentation and Copyright

Training materials provided during sessions are protected by copyright and may only be used for personal purposes.

Theft or Damage to Personal Property

The training provider assumes no responsibility for the loss, theft, or damage of personal belongings of any kind brought by trainees to the training premises.


SECTION 3: DISCIPLINE – SANCTIONS – PROCEDURES

Decisions

In cases where a trainee’s behavior disrupts the training or violates these Internal Regulations, the organizer or trainer may take necessary measures to ensure the smooth running of the session.

Sanctions

Any violation of these regulations may result in disciplinary action.

A sanction, as defined by Articles R. 6352-3 and following of the French Labor Code, refers to any measure, other than verbal warnings, taken by the training organization’s manager or representative in response to conduct deemed inappropriate. Such measures may affect the trainee’s continued presence in the training or the continuity of their education.

Depending on the severity of the violation, the sanction may be:

  • A warning.
  • A reprimand.
  • Permanent expulsion.

Fines or other financial penalties are prohibited.

The training organization’s manager must inform:

  • The employer, if the trainee is an employee attending the training as part of a company training plan.
  • Both the employer and the funding organization if the trainee is attending the training under a professional development leave.

Disciplinary Procedure

No sanction may be imposed without first informing the trainee of the alleged misconduct.

If the training organization’s manager or representative intends to impose a sanction affecting the trainee’s presence in the training, the following procedure applies:

  • The manager or representative summons the trainee, specifying the reason for the meeting.
  • The summons indicates the date, time, and location of the meeting, is sent in writing via registered letter, or is handed to the trainee with acknowledgment of receipt.
  • During the meeting, the trainee may be assisted by a person of their choice. The summons must mention this option.
  • The manager or representative states the reasons for the proposed sanction and collects the trainee’s explanations.
  • The sanction may be imposed no earlier than one full day and no later than fifteen days after the meeting or, if applicable, after the opinion of the disciplinary committee. The decision must be communicated in writing, specifying the reasons, and delivered to the trainee either in person with acknowledgment of receipt or by registered letter.

If the misconduct resulted in immediate temporary exclusion, no final sanction may be imposed without first informing the trainee of the allegations and, if applicable, following the above procedure.
